    Who actually applies

    The Canadian employer files the LMIA application with ESDC under the Temporary Foreign Worker Program. The worker's role is to be a strong, eligible candidate the employer wants to hire.

    Employer eligibility

    • Active, registered Canadian business in good standing.
    • Financial viability evidence (T2, business licence, payroll records).
    • Genuine job offer at or above the prevailing wage for the NOC + region.
    • No history of non-compliance under the TFWP.
    • Completed recruitment (see below).

    Worker eligibility

    • Meets the NOC's requirements (education, certifications, experience).
    • Admissible to Canada (criminal, medical, identity).
    • Honest about work eligibility and intent.

    The recruitment requirement

    For most streams, the employer must show they tried to hire Canadians and PRs first. The standard is typically: post the job on Job Bank plus 2 other channels, run ads for at least 4 weeks, target Canadian audiences. The Global Talent Stream and the Atlantic Immigration Program have lighter requirements.

    What the employer submits

    • LMIA application form for the relevant stream.
    • $1,000 CAD processing fee per position.
    • Recruitment evidence (job ads, applicant logs, interview notes).
    • Business legitimacy documents.
    • Job offer detailing wage, benefits, hours and start date.
    • For low-wage: transition plan, transport, housing details.

    After a positive LMIA

    1. ESDC sends the positive LMIA to the employer.
    2. Employer gives the worker a copy of the LMIA + signed offer letter.
    3. Worker applies to IRCC for an LMIA-based work permit (separate fee, separate timeline).
    4. Once the work permit is approved, the worker can enter Canada and start the role.
